The life care plan adheres to peer reviewed methodology to ensure accurate projection of future cost of care and supportive services. We utilize the 80th percentile of usual, customary and reasonable charges for medical procedures. This means that 80 percent of providers in a particular geographic region will charge an amount for a medical procedure equal to or less than the insurance UCR rate. If the surgeon provides an estimate of $20,000 for a procedure but the 80th percentile is at $17,000, you will have a better chance of settling with the insurance with the 80th percentile than with the recommended surgeon’s fees. This will save you time and additional costs in the end. Our practice utilizes proprietary software for accurate cost projection. The costs we come up with are legally defensible. We identify where the plan strays from accepted methodology, lacks medical foundation, or overstates costs, providing attorneys with a solid foundation for cross-examination, mediation, and trial.  We strengthen your case by thoroughly analyzing the opposing life care plan to uncover weaknesses and inaccuracies. First, we expose weaknesses in the opposing plan by identifying recommendations that are speculative, redundant, or outside the scope of the treating providers. Next, we challenge cost projections by verifying pricing against reliable, regional UCR (usual, customary, and reasonable) data to reveal inflated estimates. We also highlight methodology errors, demonstrating when the opposing expert fails to adhere to professional guidelines.

Medical cost projection is similar to a life care plan to address the short term medical needs of injured individuals. These individuals are not expected to require life long care to address their medical needs. The medical cost projection is very appropriate for soft tissue injuries that may require future surgery and rehabilitation. Similar to a life care plan, we utilize the 80th percentile of usual, customary and reasonable charges for medical procedures. In addition, as a licensed physical therapist, our projections will include evidence based and accurate number of physical therapy sessions for a particular injury or surgery that are defensible in court. Turn around time is 4-6 weeks.  Available nationwide.

Functional Capacity Evaluation

A functional capacity evaluation is the gold standard for assessing physical functioning and abilities. It is administered usually by a licensed physical or occupational therapist with training in FCE to assess one’s ability to safely lift, carry, push or pull objects necessary for both daily life and work participation. It also assesses various functional abilities such as stair climbing, stooping, crouching, kneeling, crawling, reaching, and foot control as well as balance and positional tolerances. Other areas assessed include grip and finger strength as well as sensation and work endurance. We utilize several consistency of effort testing to assess the amount of effort exerted during testing. The FCE can be used to provide an objective, unbiased measurement of limitations to help explain residual functional capacity or return to work.  The exam determines how an injury may affect day to day and work related activities. The exam is comprehensive and lasts approximately 4 hours. Turn around time for report is 1 week after evaluation.  Available in Texas only.
